Terms of Service

These Terms govern access to and use of the website and tools available at charactertraits.co (the “Site,” including any subdomains we operate). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are
The Site is operated by the publisher identified on the Site (the “Operator,” “we,” “us,” or “our”). Certain features may rely on infrastructure or model providers described in our Privacy Policy. For legal notices or operational contact, write to hi@charactertraits.co.
2. The service
charactertraits.co provides a creative-writing aid that helps fiction authors combine character traits, story backdrop, and dramatic pressure beats into structured “behavior sheet” style outputs. The Site may change, improve, or discontinue features at any time. We do not guarantee uninterrupted access, error-free operation, or that outputs will meet your creative, commercial, or publication requirements.
3. Eligibility and acceptable jurisdictions
You represent that you have the legal capacity to enter into these Terms where you live. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization. You are responsible for complying with all laws and third-party platform rules that apply to you (including workplace policies, marketplace terms, and content moderation rules).
4. Accounts
The Site may be offered without a user account. If we introduce accounts, registration requirements, or paid tiers in the future, additional terms may apply and will be presented at the time you sign up or purchase.
5. Your inputs and license to operate the service
You retain rights you already have in text and selections you submit. To run the tool, troubleshoot abuse, improve quality, and maintain logs as described in our Privacy Policy, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, cache, and display your inputs solely for operating, securing, and improving the Site and related services, and to create aggregated or de-identified analytics that do not identify you.
You represent that your inputs do not violate law or third-party rights and that you have authority to grant the license above. Do not submit highly sensitive personal data (for example government ID numbers, financial account credentials, or health records) unless you have a lawful basis and understand how subprocessors process data.
6. Acceptable use
You agree not to, and not to attempt to:
- use the Site to generate, distribute, or facilitate unlawful content, fraud, malware, or security exploits;
- harass, threaten, defame, or incite violence toward any person or group;
- generate sexual content involving minors, or content that sexualizes minors, in any form;
- misrepresent AI-generated text as human-written in contexts where such misrepresentation is unlawful or deceptive;
- scrape, crawl, harvest, or bulk-export the Site in a way that degrades service for others;
- probe, bypass, or defeat rate limits, access controls, bot protections, or other security measures;
- reverse engineer the Site except where applicable law expressly permits non-waivable rights;
- use the outputs to train competing generalized AI models on our prompts, templates, or proprietary materials where prohibited by future terms or technical controls we announce.
We may investigate suspected abuse, refuse service, throttle requests, block IP ranges or fingerprints, remove cached responses, or cooperate with law enforcement when required by law.
7. AI-generated outputs
Outputs are produced using large language models and automated parsing. They may be inaccurate, repetitive, inconsistent with your canon, offensive, or unsuitable for publication. Outputs are not legal, medical, financial, or therapeutic advice. You are solely responsible for reviewing, editing, fact-checking, and deciding how to use outputs, including clearing rights in any work you publish.
To the extent allowed by law, we do not claim ownership of your finished creative works that incorporate outputs. We do not warrant that outputs are original, non-infringing, or free of similarity to third-party works.
8. Intellectual property
The Site’s branding, layout, preset libraries, prompts, templates, documentation, and underlying software are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights. You may not copy, modify, distribute, sell, or lease any part of the Site except as allowed by law or with our prior written consent.
9. Third-party services
The Site may depend on hosting providers, analytics, content delivery networks, and AI model services. Their terms and privacy practices may also apply. We are not responsible for third-party services we do not control.
10. Feedback
Send suggestions, problem reports, or feature ideas (“Feedback”) to hi@charactertraits.co. By sending Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use Feedback for any purpose without obligation to you, unless we agree otherwise in a signed writing.
11. Suspension and termination
We may suspend or terminate access to the Site, with or without notice, if we reasonably believe you violated these Terms, created risk or possible legal exposure, or if we discontinue the service. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnity, and governing law) will survive.
12. Disclaimer of warranties
THE SITE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50) IF YOU HAVE NOT PAID US FEES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Indemnity
You will defend, indemnify, and hold harmless the Operator and its affiliates, directors, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your inputs, your use of outputs, your violation of these Terms, or your violation of applicable law or third-party rights.
15. Governing law and disputes
Unless mandatory consumer protection law in your country says otherwise, these Terms are governed by the laws applicable to the Operator’s place of establishment, without regard to conflict-of-law rules. Courts in that jurisdiction may have exclusive venue, except where prohibited. If you are a consumer in the European Economic Area or the United Kingdom, you may also have mandatory rights under local law that cannot be waived by contract.
16. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice (for example, a banner on the Site). Your continued use after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.
17. Miscellaneous
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site.
